Project v Hutt - Chairman's comments before hearing any evidence could suggest that had prejudged the issue [2006] EAT

An employee won an unfair dismissal claim. The EAT has remitted the case to a freshly constituted tribunal because they were satisfied that comments by the chairman of the original tribunal "were such as to give the impression that there was a real possibility of pre-judgment". Prior to the hearing of any evidence, the Chairman had told the employer's representative that he may be in some difficulties in the light of what was contained in the productions.
