Prowse-Piper v Anglian Windows Ltd & Others - Tribunal erred in failing to resolve a specific issue before it  EAT
An employment tribunal erred in failing to resolve an allegation of sex discrimination which was clearly put before it.
Ms Prowse-Piper won claims against Anglian of unfair dismissal, sex discrimination and sexual harassment, all based on her pregnancy. The Employment Tribunal's decision on the unfair dismissal claim was based upon its conclusion that, although a genuine redundancy situation did exist, Anglian did not take suitable steps to explore an alternative position that was available with Ms Prowse-Piper. It did not, however, conclude that this was in itself an act of sex-discrimination - and it was on this single point that Ms Prowse-Piper appealed.
