Przybylska v Modus Telecom Ltd - Implied terms  EAT
This case shows that a term will not lightly be implied into an employment contract. The EAT has overruled an employment tribunal's decision that a term should be implied into an employee's contract giving her employer a right which had not been expressly provided for in the contract. Ms Przbylska was a new (senior) employee. Her contract provided that she was employed on a 3 month probationary.
