Pudney v Network Rail Ltd - Fairness of dismissal proceedings include appeal process [2006] EAT

The Shrewsbury Employment Tribunal found that gross misconduct was the reason for Mr Pudney's dismissal and rejected his unfair dismissal claim. However it failed to take account of a serious irregularity in the employer's procedure leading to the dismissal - the employer had failed to give Mr Pudney the opportunity to know adequately what evidence there was against him.
