Punch Pub Co Ltd (formerly Spirit Group Ltd) v O'Neill - procedural defects in dismissal process did not make dismissal unfair

if before dismissing an employee an employer complied with the minimum procedural requirements required by law in force until April 2009, his failure to comply with any additional procedural safeguards (for example, contractual procedures) will not render the dismissal unfair if  on a balance of probabilities the employee would have been dismissed anyway, even if those additional safeguards had been properly applied.
