It is not an improper use of discretion to award costs where an application for review has been dismissed at a preliminary stage

Mr Purohit made claims against the Respondent in the ET, all of which failed. Mr Purohit applied for a review of the decision reached by the EJ on the papers that Mr Purohit pay a part of the Respondent's costs, valued at £2000, incurred in responding to the application for a review. Mr Purohit appealed against the order for costs. His appeal failed.
