In assessing compensation for unfair dismissal, a tribunal should not cap compensation at the point where a limited work permit and leave to enter the UK expires. It should take into account that the employee is likely to apply for indefinite leave to remain and the fact that, both while this process is ongoing and - potentially - after its conclusion, the employee may still be lawfully employed.
