Radakovits v Abbey National Plc - Reasonable belief that dismissal procedure is being followed and automatic extensions of time [2008] EAT

Mr Radakovits was one of 200 employees dismissed by Abbey. With his manager's assistance (she was also being dismissed) he took extensive legal advice - but she gave a wrong date and, as a result, his advisers miscalculated his last day of employment. Mr Radakovits made a "tactical decision" to present his employment tribunal claim on the very last day of the three month time limit period - actually 26th January 2008 - but due to the miscalculation he was one day late when he presented his complaint on 27th. The employment tribunal rejected his claim, and he appealed.
