Ralph Martindale & Co Ltd v. Harris - Selection for redundancy [2007] EAT
Martindale needed to make redundancies. Two managers, one of which was Mr Harris, were at risk; a single new post was created, and opened to an internal competition. Mr Harris was unsuccessful. An employment tribunal found the dismissal unfair - the criteria to select between the two were totally subjective, and with two people at risk of redundancy the new role should have been opened to further applicants only once it was clear that neither was suitable.
