Ratcliffe Duce and Gammer v. Binns (t/a Parc Ferme N McDonald) - Wasted costs order against solicitors set aside [2008] EAT

Ratcliffe Duce & Gammer is a firm of solicitors with offices in Reading, Wokingham and Wallingford. They were conducting an unfair dismissal case on behalf of a client. At a preliminary hearing the employment tribunal ruled that the claimant did not have the 12 months continuous employment needed for bringing such a claim. The tribunal went on to rule that, given the particular circumstances, a wasted costs order should be made against the solicitors "pursuant to rule 40(3)" of the tribunal rules of procedure. The solicitors appealed to the EAT.
