Real Time Civil Engineering Ltd v Callaghan - Requirement of personal service for contract of employment [2005] EAT

The EAT restates that if there is an unconditional clause in a contract which allows a worker to send a substitute then that contract cannot in law be a contract of "employment" (unless of course the clause is a sham).
