Renfrewshire Council v Ferguson - Tribunal wrong to conclude that statutory dismissal procedures were not complied with  EAT
Renfrewshire Council dismissed gardener Mr Ferguson, and that dismissal was held by an employment tribunal to be unfair. He had been dismissed following a disciplinary hearing, and his letter of dismissal advised him of his appeal rights. He wrote to the Council, oustide of the 14 day time limit for appeal, saying that he had taken trade union advice and would be claiming unfair dismissal - as he subsequently did. The Council did not take this letter to be an appeal and made no arrangements for one.
