Rev Allan Macdonald v Free Presbyterian Church of Scotland - clergyman was an office-holder and was not an employee

An employment tribunal found that a Minister of the Free Presbyterian Church of Scotland was an office holder and was not an employee of the Church.  The EAT has dismissed an appeal based mainly on argument that the tribunal had failed to give adequate reasons for its decision.

The Rev Allan MacDonald had his unfair dismissal claim rejected by an Inverness employment tribunal because it found that he was an office holder, not an "employee"  of the Free Presbyterian Church of Scotland as defined by Employment Rights Act 1996 s.230.
