Riley v First Choice Homes Oldham Ltd - The "trip-wires" of the modified statutory grievance procedure [2008] EAT

Under the Employment Act 2002 and associated Employment Act 2002 (Dispute Resolution) Regulations 2004, two forms of statuory grievance procedure exist - the "standard" and the "modified". Essentially the latter is intended to apply where the employee is no longer employed, and provides for the matter to be dealt with in writing. The modified procedure does, however, have a requirement that there be written agreement between the parties that it be used.
