Ritchie v (1) Shawcor Inc (2) Omsco Inc - Undertaking must be situated in the UK immediately prior to transfer to fall within jurisdiction of TUPE [2008] EAT
The issues in this case concerned a claim of unfair dismissal in connection with a TUPE transfer. Ultimately the EAT was called upon to resolve the question of which matters relating to jurisdiction had or had not been conceded at a pre-hearing review. Having done so it remitted the case to the employment tribunal for full hearing.
