Roadbeach Ltd v Werner - Failure to offer an oral hearing on appeal against selection for redundancy need not render dismissal procedurally unfair EAT
Roadbeach made Mrs Werner redundant. Most of her complaints to the employment tribunal were dismissed. However the tribunal found her dismissal was procedurally unfair. It considered that, since Mrs Werner had not taken the opportunity to consult on her redundancy (by which she contributed to her dismissal), a reasonable employer would give her the opportunity for an oral hearing with the person considering her internal appeal, not just deal with it on paper. Roadbeach appealed.
