Roberts v Governing Body of Whitecross School - anticipatory fundamental breach in deliberate underpayment of wages

Where an employer, relying on an understanding of contractual terms as to pay, intentionally pays less than is due, that will amount to a fundamental breach of contract, founding a claim for constructive dismissal. It makes no difference that the employer's view was based on a genuine and mistaken belief as to how the contract should be interpreted.
