Roberts v Valley Rose Ltd (t/a Fernbank Nursing Home) - Whistleblowing must not be in bad faith [2007] EAT

Miss Roberts claimed that she was unfairly dismissed from her job as a nurse in a care home for the elderly. The original tribunal held that she was fairly dismissed for "a catalogue of misconduct", and not because she made "whistleblowing disclosures" about poor treatment of patients. In any event, they concluded, at least some of her disclosures were made in bad faith.
