Rodrigues v Co-operative Group Ltd - exceptional circumstances justified rare strike out of discrimination claim at PHR stage
An employment judge can only properly strike out a discrimination claim at a PHR for having no reasonable prospects of success in exceptional circumstances: this was an example of such an exceptional case.
Mr Rodrigues was a contract cleaner who brought claims of race discrimination, essentially alleging that he was suffering racial harassment and that his managers did nothing about it.
