Strike-out for non-compliance with order applies to whole claim: even where there has been partial compliance there is no power to allow part of a claim to proceed.
Mrs Abraham brought claims of sex discrimination and unfair dismissal. She failed to comply with orders requiring the provision of a schedule of loss and certain further particulars. An Unless Order was made, stipulating that the Schedule of Loss and particulars should be provided by a set date, and those particulars should show why the claims should not be struck out. On the very last day, Mrs Abraham provided some information, but RBS maintained that she had failed to comply.
