Royal Mail Group Plc v (1) Double (2) Dennis - Tribunal should set out its reasons in systematic matter  EAT
An employment tribunal held that Royal Mail unfairly dismissed Mr Double and Mr Dennis for misconduct. The EAT has allowed Royal Mail's appeal and remitted the case to a fresh tribunal. The tribunal had failed to apply the proper tests for a conduct dismissal. Its role is to "decide, on the basis of the material which was available to the employer, whether the dismissal was fair or unfair including consideration of the procedure which was adopted."
