Saiger v North Cumbria Acute Hospitals NHS Trust - exemplary damages are a punishment, not compensation.

The EAT has confirmed that an award of exemplary damages is intended to punish, not to compensate.

Dr Sarina Saiger won her race discrimination claim against North Cumbria University Hospitals NHS Trust some while ago (see emplaw notes of 24th March 2009).  At a remedies hearing she was later awarded £115,000, including compensation for loss of earnings and injury to feelings (see emplaw notes of 19th January 2010).
