Saini v (1) All Saints Haque Centre (2) Bungay (3) Paul - using employee to implement discriminatory policy, even in order to harass a different employee, amounts to unlawful discrimination [2008] EAT
The factual background to this case was complex. Immigration advice worker Mr Saini was a Hindu. Messrs Bungay and Paul, directors of All Saints were Ravidassis (members of a different religious group) and wanted rid of Mr Saini's Hindu colleague Mr Chandel. They tried to achieve this by taking disciplinary action against Mr Saini in respect of a number of complaints about him. They did not carry out a fair process, but instead one which set about indirectly gathering evidence against, and generally targetting, Mr Chandel.
