Salans v Carter-Smith - Inadequate reasons provided for decision [2006] EAT

A 25 year old ex-employee won a constructive unfair dismissal claim against Salans, the international law firm.

The Ashford ET awarded him nearly £14K compensation, mostly for loss of future earnings. Salans had argued that he should be awarded much less because he had failed properly to try to mitigate his loss of future earnings. The Tribunal, made no reference in their judgment as to how, or indeed whether, they had resolved the mitigation issues which Salans raised.
