Sanderson & anor v Exel Management Services Ltd - Normal working hours and holiday pay calculation [2006] EAT

Calculation of holiday pay depends on whether or not the worker concerned has "normal working hours" as defined. If he is entitled to overtime, this in turn depends on whether he has "a fixed number of hours in a week" (ERA 1996 s.234(1)). The importance is that if a worker does not have "normal working hours" his holiday pay is calculated by reference to average weekly pay in the previous 12 weeks.
