Sandhu v Jan de Rijk Transport - dismissal or resignation?

Mr Sandhu was called to disciplinary meeting and told that he would be dismissed for misconduct. He negotiated a retirement package and left on its terms. Nevertheless he then claimed unfair dismissal.

The Reading Tribunal rejected his claim, finding that he had left voluntarily and was not dismissed.

He appealed to the EAT which rejected his appeal.
