Sarti (Sauchiehall St) Ltd v Polito - Employment tribunal does not have jurisdiction to determine entitlement to statutory sick pay [2008] EAT
Mr Polito went off sick, but when Sarti heard reports that he had actually been working it withheld his Statutory Sick Pay (SSP), saying it would not release it until the Benefits Agency confirmed that it could do so. No amount of pressure from Mr Politio or his solicitors would move Sarti from this position - it feared being found complicit in benefit fraud.
