Scargill v National Union of Mineworkers [2010] EAT

The EAT has agreed with the Certification Officer that the so-called Yorkshire Area Office Branch is not properly consituted as a "branch" of the National Union of Minworkers under the rules of the NUM.  The EAT has also ruled that statutory rules concerning elections to senior positions in trade unions (TULRCA 1992 s.50) do not apply to preliminary processes undertaken to select candidates for those senior positions.
