Scottish Shellfish Marketing Group Ltd v Connelly - Perverse decision by ET [2006] EAT

Mr Connelly was dismissed on the basis of a medical report which found that he was unfit to return to work. He won a claim for unfair dismissal essentially because the tribunal found that the employer had given the doctor who prepared the report erroneous information about the manual labour element of Mr Connelly's job. On appeal by the employer, the EAT held that the tribunal's decision was perverse as there was no basis for that finding and without it they could not have reached the decision that they did . The case was remitted to a fresh tribunal for rehearing.
