Secretary of State for Justice v Hibbert - time limit with ambiguous resignation

"I have no alternative but to resign my position" was found to be unambiguous, despite later correspondence and a subsequent served notice period, so the claim was out of time.

Mrs Hibbert commenced employment as a Works Escort at HMP Wakefield in February 2008. After problems at work she instructed solicitors and started sick leave. Grievance and potential capability and dismissal steps were taken, with the grievance, which was scheduled first, being dismissed. Two days after that, Mrs Hibbert wrote the letter of the 29th June 2012 including the lines:
