Secretary of State for Justice v Macdonald - Heaney - Tribunal wrongly substituted its own view for that of prison governor [2011] EAT

The Tribunal was wrong to substitute its own view that allegedly inconsistent evidence was unreliable. A strict approach towards sanctions was justifiable in the case of a prison officer's assault on a prisoner. Procedural flaws in the handling of the appeal did not necessarily vitiate the fairness of the dismissal.
