SG Baker Ltd v Haggart - onus of proving disability rests on claimant

In a disability discrimination case the onus lies on a claimant to demonstrate that he was disabled at the time of the alleged detrimental treatment; it is not for the respondent to prove that he was not. Furthermore, in deciding the question, the tribunal must not take account of developments after that date.
