Shipperley v Nucleus Information Systems Ltd - constructive unfair dismissal case [2007] EAT

The Bedford Employment Tribunal found that Mr Shipperley had not been constructively unfairly dismissed even though the employer admitted non-payment of wages.

The tribunal concluding that his resignation had been motivated by a desire to de-stabilise the company and had not considered the non-payment of wages point.

On appeal, the EAT acknowledged the possible relevance of Mr Shipperley's conduct but remitted the case to a fresh Tribunal to deal with the issue of constructive dismissal.
