Sidhu v Superdrug Stores PLC - Procedural defects in dismissal case [2006] EAT

Mr Sidhu won an unfair dismissal claim "by reasons (sic) of serious procedural defects" but compensation was reduced by 90% by reason of his conduct before the dismissal.

The EAT has remitted the case back for reconsideration for three reasons (i) it is unfair to decide a point adversely to a party without giving him an opportunity to address it; (ii) the tribunal had not given adequate reasons for its decision; and (iii) in assessing compensation it is generally wrong to take into account the way in which the claimant behaved at a disciplinary hearing.
