SKS Ltd v Brown - Extension of time to accept response to claim [2007] EAT

SKS dismissed Mr Brown who presented an unfair dismissal claim to the employment tribunal. SKS responded in good time but the envelope containing their response was not properly franked. As the tribunal would not pay excess postage it was returned to SKS. SKS immediately faxed details of their response, and then asked for and completed a form ET3. By then the time for responding to the claim had expired. A Chairman refused to accept the fax or the ET3 and rejected a review application. SKS appealed
