Smart Interiors Contractors Ltd v Thomas - Costs awarded to employer [2006] EAT
The EAT, overruling an employment tribunal, ordered an employee to pay the employer's costs of £4,732.45. The employee's claim had been struck out at a pre-hearing review as he failed to comply with Tribunal orders and had conducted the proceedings unreasonably. The breach of the Tribunal's orders had caused substantial costs to the employer and no explanation had been put forward as to why the "breach ... should not be the subject of a costs order". However the EAT refused to award costs in respect of the appeal itself. but refused to award costs of the EAT application..
