Smith v Greenwich Council & Others - in circumstances of case, walking out of hearing was not "withdrawal of claim"
When faced with a claimant who, by walking out of a hearing, appears to be abandoning his claim, an employment tribunal should expressly ask whether he is "withdrawing his claim" - only giving judgment to that effect in the light of a positive answer.
Youth worker Mr Smith brought employment tribunal claims for unfair dismissal and disability discrimination against Greenwich Council and 8 of its employees.
