Smith v Ideal Shopping Direct Ltd - conclusion that dismissal was 100% certainty in any event needed justification

A tribunal's conclusion that dismissal 4 days after a summary dismissal was, in any event, a 100% certainty could not stand without adequate justification and explanation.

Following an altercation with a colleague, Mr Smith (who was gay) raised concerns about homophobic treatment in the workplace. The colleague made a complaint, a disciplinary process was started, but four days before the hearing Ideal Shopping summarily dismissed Mr Smith, apparently for the very reasons that led to the disciplinary process being initiated.
