Smith v. Network Rail Infrastructure Ltd - Grievance procedure and continuing failures by an employer  EAT
The EAT has remitted this case for rehearing before a fresh Employment Tribunal. Mr Smith lost a disability discrimination claim at the Manchester employment tribunal. He had suffered a number of strokes, had an operation for removal of a tumour and his eyesight had deteriorated significantly. He claimed that his employer, Network Rail, made no proper attempt to make reasonable adjustments to accommodate him.
