Sodexho Healthcare Services Ltd v Harmer - Pre-Hearing Review should involve an actual hearing, with exchange of oral evidence [2009] EAT
Sodexho dismissed Ms Harmer from her job as head chef on 5 December 2007. She presented a claim for unfair dismissal at the employment tribunal on 27 March 2008 - 23 days outside the statutory three-month time limit (Employment Rights Act 1996 s 111(2)). An employment judge concluded that it had not been reasonably practicable for her to submit the claim in time, on the basis that she had proceeded on mistaken advice from her trade union adviser. It extended time to allow her claim to be admitted. Sodexho appealed - and won.
