Sodexo Ltd v (1) Gutridge & Others (2) North Tees & Hartlepool NHS Foundation Trust - equal pay claims, TUPE transfers, and relevant time limits

Mrs Gutridge and her colleagues were cleaners, employed by the Trust until July 2001. Their employment then transferred, under TUPE, to Sodexo. They brought equal pay claims in December 2006, arguing that the statutory equality clause implied into all employment contracts by the Equal Pay Act 1970 conferred on them a contractual entitlement which the Trust was obliged to honour and which therefore transferred to Sodexo - against whom they sought to enforce it. An employment tribunal found in their favour and Sodexo appealed, arguing that the claims were out of time.
