South Ayrshire Council v Aitchison & ors - compliance with the (now repealed) 2004 statutory grievance procedure rules

The requirement of the now repealed statutory Grievance Procedure that the names of employees bringing a grievance must be provided "in writing" is not satisfied by their providing a disc or USB stick containing many hundreds of names of which only a small proportion are those seeking to bring a grievance. This is because (even if the content of a computer disc can count as "writing", which the EAT doubted) it must be possible at the time when the list of names is supplied for the employer to identify those who wish to raise a grievance.
