South Gloucestershire Council v. Bennett - Compensation for loss of pension rights [2006] EAT

Mrs Bennett, who was employed by the Council as a home carer, brought a successful claim for constructive unfair dismissal following the termination of her employment. She became unwell as a result and was confirmed to be still medically incapable of work at the time of the remedies hearing. The Tribunal's subsequent (and substantial) award for loss of earnings and loss of pension was challenged by the Council as perverse and punitive, but was upheld by the EAT on appeal.
