St James Management Services Ltd v Power - dismissal was rightly found to be more than just procedurally unfair
Where an employer's actions in dismissing an employee go to the substantive issue of unfairness, and beyond mere defects in procedure, there can be no application of the now repealed Employment Rights Act 1996 sec 98A(2) whereby a dismissal can be rendered fair by showing that it would have happened anyway.
