St Thomas Garnett School Association Ltd v McCarthy - Range of reasonable responses test on unfair dismissal [2006] EAT

The Southampton employment tribunal found that a teacher at the St Thomas Garnett school had been unfairly dismissed. The tribunal found that dismissal was outside the range of reasonable responses to the teacher's misconduct, noting that the Headmaster had said that he would be satisfied that the teacher would not have committed further misconduct if she had been given a final written warning rather than being dismissed.
