Stewart v Next Retail Ltd - incorrect use of Polkey to make deductions from basic award

A "Polkey deduction" can only be made from a compensatory award and only in cases where the dismissal was unfair due to procedural errors. It cannot be applied to a basic award in a case of substantive unfairness.
