Sunderland City Council v (1) Brennan (2) Unison (3) GMB - Challenge to job evaluation scheme must be considered before genuine material defence is heard [2008] EAT
Over 1000 complex equal pay claims were brought against employer Sunderland CC. A 2005 Job Evaluation Scheme (JES) had rated the jobs of the claimants and their comparators as being of equal value. Sunderland therefore put forward two different Genuine Material Factor (GMF) defences, one pre-2005 and one post-2005.
