Surrey County Council v Hay - Disability Discrimination and risk assessments [2006] EAT
The London (South) Employment Tribunal awarded £45K for unfair dismissal and £1K for disability discrimination (injury to feelings) to Ms Hay. Her work for Surrey CC's library service involved her driving a lorry and carrying books. The decision was substantially based on the fact that Surrey CC had not conducted a formal risk assessment. The EAT has allowed Surrey CC's appeal.
