Surrey County Council v Henderson - Unfair and wrongful dismissal - witnesses identity kept hidden  EAT
Appeal by employer against tribunal finding that employee was unfairly dismissed. Main ground for unfair dismissal finding was that employee was unable to present an effective defence as he was not told details of complaints against him in order to protect witnesses. EAT finds tribunal failed to apply correct "reasonable response" test and had instead substituted its own view for that of the employer. Appeal therefore allowed to the extent that case is remitted for rehearing.
