Swallow Security v Millicent - tribunal MUST consider reducing compensatory award if claimant guilty of culpable contributory misconduct

When assessing compensatory award on unfair dismissal an Employment Tribunal, having found that there was conduct on the part of an unfairly dismissed employee that was or could be regarded as blameworthy, is bound by Employment Rights Act 1996 s.123 to consider contributory fault even if the employer has not raised the point
